Terms and Conditions

A. Introduction

1. These terms and conditions set out the conditions upon which persons are entitled to become a member (hereinafter the "Member") of the British Athletes Commission (the "BAC") and the conditions of such membership (the "Membership").

2. The website is operated for the BAC by Clock, Clock Limited, The Old School House, Bridge Road, Hunton Bridge, Herts, WD4 8RQ, UK.

B. Types of Membership

3. Membership is available at the following levels: Full, Standard, TASS & Sports Aid, Alumni or Associate Membership (the "Categories"). There are variations to Membership depending on the Category of Membership. Members should be aware of the type of Category to which they belong, as this may be liable to change from time to time.

4. Members will be entitled to join a Category as follows:
(a) Full - all Podium and Development athletes on a World Class Performance Programme;
(b) Standard - all Podium and Development athletes on a World Class Performance Programme who do not wish to pay for BAC Benefits;
(c) TASS & Sports Aid - TASS and Sports Aid funded athletes;
(d) Alumni - athletes who have participated as, but are no longer athletes. As a part of Category 4 (a) retiring athletes will automatically attain Alumni Member status (any Full Member not wishing to become an Alumni Member should notify the BAC by contacting the membership co-ordinator membership@britishathletes.org );
(e) Athlete Support Personnel - all athlete support personnel including Coaches, Performance Directors, EIS and NGB support staff (f) Associate - a person willing to support the work of the BAC (not necessarily an athlete).

5. The Member's Category will determine the entitlements to which the Member is entitled as set out below:

6. The benefits of Membership (the "Benefits") and the BAC services (the "Services") available are listed in our "Benefits" section. The voting rights are laid out in the BAC Articles of Association.

7. Any additional entitlements made available by the BAC which are not described in these terms and conditions are provided on a purely discretionary basis and may be withdrawn at any time.

8. The BAC may from time to time change or amend the Benefits or Services which are offered to Members.

C. Cost of Membership

9. The cost of Membership is as follows:

10. When the Member wishes to join the BAC, the cost of Membership for the Membership Year will fall due immediately. (Full Members may pay in monthly instalments)

11. The Member has the right to cancel the Membership within 7 working days beginning with the day after the day on which the Member joins the BAC. The Member will receive a full refund of the cost of Membership paid. Any Member that accepts a Benefit or Service as set out above forfeits the right to cancel the Membership pursuant to this clause.

12. The cost of Membership will be revised annually and will be notified to the Members on the BAC's website.

13. Any Full Member who changes to the status of Alumni Member during the course of a year for which the Full Member has paid on an annual basis will continue to receive the Full Member Benefits, Services and entitlements for the remainder of the year which the Member has paid for, but no refunds for Membership already paid for will be given.
Any Full Member who changes to the status of Alumni Member during the course of a year for which the Full Member has paid on a monthly basis will continue to receive the Full Member Benefits, Services and entitlements for the remainder of the year which the Member has paid for, and will pay the cost of Membership for an Alumni Member on a pro rata basis but no refunds for Membership already paid for will be given.
Any Full Member who changes to the status of Alumni Member during the course of a year for which the Full Member has paid on a monthly basis will continue to receive the Full Member Benefits, Services and entitlements for the remainder of the year which the Member has paid for, and will continue to pay monthly at the same level for the remainder of the year, at which point they will become an Alumni member

Any Standard or TASS & Sports Aid Member who changes to the status of Full Member during the course of a year will receive the Full Member Benefits, Services and entitlements for the remainder of the year and will pay the cost of Membership for a Full Member on a pro rata basis.

14. Payment for the Membership on an annual basis is by credit/debit card and payments are taken online. Payments may be made by MasterCard, Visa, Maestro. By using a credit/debit card to pay, the person using it confirms that the card being used is their own. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of the card refuses to authorise payment the BAC will not accept payment and will not be liable for any delay or non-delivery. The BAC is not obliged to inform the card user of the reason for the refusal. The BAC is not responsible for the card issuer or bank charging the card user as a result of the BAC's processing of the credit/debit card payment.

15. Membership is continuous, until the Member notifies the BAC in writing and a period of 1 month from the receipt of such notification by the BAC has elapsed.

16. If Membership is paid annually by credit/debit card, the BAC will renew Membership automatically at the end of each year, unless the credit/debit card details have expired in which case the Member will receive an automatically generated e-mail requiring the details to be updated. A reminder will be sent to all Members to advise of the premium. If the Member does not want to renew on this basis, written notification should be sent within 7 days of receipt of such reminder. If the BAC receives notice that the Member's Category has changed, the BAC will change the Member's details, and the credit/debit card payments will change automatically.

17. It is the Member's responsibility to ensure that all payment details including credit card/debit card is up to date and the correct details are in the BAC's possession. Any Member who does not update their details will not be able to receive any Benefits, Services or other entitlements and BAC partners will be notified accordingly.

18. Payments not received within 1 month of becoming due, including annual and monthly payments, will result in the Membership being considered lapsed and all entitlements may be suspended pending payment. However, Membership charges will continue to accrue, and an administration fee may be incurred until notification in accordance with the above has been received.

19. No refund to Members will be made for payments received, except under clause 11.

20. Rates are inclusive of VAT, which is payable on all services directed to UK addresses.

D. General

21. Members are responsible for their own conduct and will not partake in any activities that will bring the BAC into disrepute.

22. These terms and conditions of Membership may be revised from time to time and Members will be notified by email.

23. The BAC shall not be liable to a Member for changes in Benefits, entitlements or Service failures.

24. The BAC shall not, in any event and to the extent permitted by law, have any responsibility for any increased costs or expenses, any loss of profit, employment, business, contracts, revenue or anticipated savings or for any special, indirect or consequential losses incurred as a result of or in connection with any Memberships, whether resulting from tort (including negligence or breach of statutory duty), breach of Agreement or otherwise. For the avoidance of doubt, nothing in these terms and conditions shall exclude or restrict the BAC's liability for negligence resulting in death or personal injury.

25. The BAC will not be liable for any event or action of a third party supplying any of the Benefits and/or Services mentioned above which causes any increased costs or expenses, any loss of profit, employment, business, contracts, revenue or anticipated savings or for any special, indirect or consequential losses incurred as a result of or in connection with any Memberships.

26. All notifications pursuant to these terms and conditions should be sent to, The British Athletes Commission Ltd, Bisham, Marlow, SL7 1RR.

27. The BAC reserves the right to terminate a Member's Membership or refuse any person the right of Membership at any time.

28. Personal and payment details are held by the BAC and by our internet service providers. These details will be kept private and will not be shared with any Third party.

29. The Member acknowledges that all Intellectual Property Rights belonging to the BAC, including but not without limitation any copyright, trade marks, designs, patents or other such rights are for the BAC'S sole and exclusive use and shall not be used by the Member without the BAC's written permission.

30. If any provision of these terms and conditions (or part of any provision) is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed not to form part of these terms and conditions, and the validity and enforceability of the other provisions of these terms and conditions shall not be affected.

31. Each party undertakes that it shall not at any time disclose to any person any confidential information concerning the business, affairs, or clients of the other party.

32. These terms and conditions constitute the whole agreement between the parties and supersedes all previous agreements between the parties relating to its subject matter.

33. None of these terms and conditions are enforceable by anyone else other than the Member. For the avoidance of doubt, and rights under the Contract (Rights of Third Parties) Act 1999, or any replacement or amendment of such act, are excluded.

34. The Membership and these terms and conditions shall be interpreted by the laws of England and Wales and any disputes hereto shall be referred to the exclusive jurisdiction of the courts of England and Wales.
